EVIDENCE:

Following the running of Race 3 Chief Stipendiary Steward Mr John Oatham presented an Information alleging a breach of Rule 638(3)(g)(i) by Jockey Akshay Balloo which was admitted. Mr Balloo confirmed to the Adjudicative Committee he was conversant with the Rule.

Mr Oatham played the replay video of Mr Balloo leading the race into the straight and the film clearly showed 6 strikes with the whip finishing well before the 100 metre marker.

Mr Balloo made no submissions.

DECISION:

Mr Balloo having admitted the breach it was deemed to be proved.

SUBMISSIONS FOR PENALTY:

Mr Oatham stated Mr Balloo had a clear record under the Rule and the Stewards would seek a fine under the NZTR Revised Guidelines.

Mr Balloo made no submissions on Penalty.

REASONS FOR PENALTY:

The Guidelines for a 1st offence provide whichever is greater of $250 fine or 50% of Jockey share of stake.

PENALTY:

Jockey Akshay Balloo is fined $250.
