FACTS

Mr Doody, the Driver of ‘CHANGEAROUND’ in Race 6 was charged with using his whip with more than a wrist flicking motion in the run home.

Mr Doody said that he understood the Rule, charge and confirmed that he admitted the breach.

Film replays were shown with the Stewards identifying the incorrect whip use early in the run home.

Mr Doody agreed that the whip was used in breach of the Rule on three occasions.

DECISION

As the charge was admitted it was deemed proved.

PENALTY SUBMISSIONS

The record showed that Mr Doody had breached the Rule on 17 November 2022 and was suspended for 2-days.

Mr Doody did not comment.

REASONS FOR PENALTY

The starting point for a second breach within six months is a 3-day suspension.

This was considered to be a suitable penalty by the Adjudicative Committee.

CONCLUSION

Mr Doody’s Open Driver’s Licence was suspended from 1 April through to 27 April 2023 (3-days).  The days being 6, 14 and 27 April 2023, all at Cambridge Harness.
